1. General provisions
1.1 The Terms & Conditions are an integral part of a travel contract (hereinafter: contract) between the traveller and Marmot OÜ (hereinafter: Marmot) and shall take effect from the moment the traveller books a travel package through the website www.mareti.ee (hereinafter: site) or any other means of communication. By later paying the price of the package in part or in full, the traveller confirms that he/she has read and accepted the Terms & Conditions.
1.2 Marmot OÜ is a tour operator registered in Estonia with the registration code 12162222 and located at Madala 30 – 4, 10315 Tallinn, Estonia.
1.3 A traveller is a person making a reservation of a travel package. The traveller must be 18 years old at the date of departure. A traveller under 18 years old at the date of departure must provide the written consent of parents and be accompanied by an adult who will be responsible for him/her during the trip. Travellers under 18 years old are not eligible to discounts.
1.4 Marmot undertakes to provide the traveller who pays the price of the travel package with the combination of travel services previously presented in the tour description on Marmot’s site, invoice / order confirmation or in a separate tour description.
1.5 Marmot shall confirm reservation with a confirmation email. A package tour is considered reserved once an invoice / order confirmation has been issued to the traveller.
A traveller can modify a reservation that has not been paid yet, in full or in part.
1.6 If a traveller make a reservation of a travel package that has been sold out, the booking will be placed on a waiting list. Marmot individually contacts travellers on waiting list to inform them if a place becomes available.
2. Prices & terms of payment
2.1 Price of the travel package includes services described in the tour description.
2.2 After the booking confirmation and issue of the invoice / order confirmation of the tour, the traveller shall pay the total travel price (or make a prepayment) before the payment deadline as specified by Marmot in its communications with the traveller.
2.3 If the traveller fails to pay the requested amount by the agreed deadline, the reservation for the package is considered withdrawn by the traveller and Marmot has the right to cancel the reservation without notice.
2.4 If a traveller does not use some of the services listed on the travel confirmation, it does not give the traveller the right to demand a reduction or redemption of the price of the package.
2.5 Once a reservation is made by the traveller, any discount or last minute offers made by Marmot do not affect the payable amount of the traveller nor gives him/her the right to right to demand a reduction or redemption of the price of the package.
3. Obligations, liability and rights of traveller
3.1 The traveller shall provide to Marmot all requested personal information which are necessary to perform the travel services. The traveller shall verify that the data provided is correct. In case the information provided was incorrect, the traveller immediately informs Marmot about any nonconformities. The traveller is liable for all expenses damages that could arise from inaccurate provided data.
3.2 The traveller shall ensure at his/her expense that he/she possesses all necessary valid travel documents that allow crossing borders and transiting countries that are being visited (passport, visa, vaccination, insurance, etc.). The traveller is liable for the existence of valid travel documents and travel insurance (travel disruption, health and luggage insurance). Outside the European Union, the ID card is not valid as an identity document. The traveller shall take with him/her a passport valid in accordance with the laws in force of the destination countries. The traveller shall have a passport that is valid for at least 6 months after the end of the journey.
3.3 The traveller is responsible for being on time at the places of departure of the journey and its activities. In case of being late, the travellers bears the responsibility and costs of missed journey, tour, visit, excursion, etc. Being late for departure is not subject to any reduction or redemption of the price of the package.
3.4 During the journey the traveller shall comply with the tour guide, the internal rules of accommodation, transportation providers and local authorities, as well as to monitor personal belongings, money, valuables and documents.
3.5 During the journey the traveller shall not abuse of alcoholic beverages and disturb fellow travellers with his/her behaviour otherwise the traveller may not be allowed on the journey or be removed from the journey, and in this case, travellers are not entitled to reimbursement of travel expenses.
3.6 The traveller shall follow the customs and immigration regulations taking into account that in case of violation the responsibility lies on the traveller.
3.7 During the journey and in the destination country the traveller shall follow the regulations established to guarantee the safety of the traveller, follow and respect the traditions and customs of the country and not to violate law.
3.8 The traveller shall ensure that he/she is not listed as persona non grata in the country of destination. If the traveller cannot enter the country of destination because he/she cannot cross the border for reasons related to the traveller, the traveller shall bear all costs of his/her repatriation and the price of the travel package will not be refunded.
3.9 The traveller shall reimburse all material damage to Marmot, its partners’ or third parties caused by his/her deliberate or negligent behaviour or failure to act on spot where the damage was done or within 10 days from the date of receipt of relevant invoice from Marmot.
3.10 If a traveller wants to return home before the end of the journey or prolong his/her stay, all additional costs incurred by Marmot shall be paid by the traveller.
3.11 The traveller shall pay for the additional services consumed at the destination country and not included in the package tour.
3.12 The traveller has the right to cancel the contract during the journey and interrupt the journey if Marmot violates the contract or the travel arrangements prove to be in some other way so incomplete that the traveller cannot reasonably be expected to continue the journey under such circumstances.
3.13 If the package tour was cancelled, the traveller has the right to get a full refund of the paid amount, or choose a replacement package tour with the same or equivalent price if available. If the replacement package is cheaper than the original one, Marmot shall return the price difference to the customer. If the replacement tour is more expensive than the original one and Marmot cannot offer it to the traveller at the same price, the traveller shall pay the price difference.
4. Obligations, liability and rights of Marmot
4.1 Marmot shall provide the traveller with the package tour as agreed in the contract.
4.2 The package tour chosen by the traveller must correspond to the description, except for circumstances beyond his control, such as weather conditions that differ from the average of many years, influential temporary or permanent political decisions and/or situations of the destination country.
4.3 Marmot shall provide all necessary assistance to the traveller in the event of accident during the journey, if falling victim to a crime or in case of any other event that might put the traveller’s life or health in danger. The assistance of Marmot consists in contacting and communicating with the local authorities and medical institutions or in providing the corresponding information and if required, arranging an anticipated repatriation. The traveller shall compensate Marmot for all expenses related to the assistance.
4.4 Marmot is not liable for any damage caused by insurmountable obstacles or other unforeseen circumstances that Marmot could not have avoided with careful operation. Such reasons could be war, natural disasters, infectious diseases, strikes, etc. (Force Majeure).
4.5 Marmot shall immediately notify the traveller of any significant change or cancellation of travel service.
4.6 Marmot is not liable for any damage arising from the negligence of the traveller and from the activities of non-contracted third parties whose actions cannot be foreseen or prevented.
4.7 Marmot has the right to make changes in the pricelist of services or extra activities offered.
4.8 If Marmot cannot adhere to the itinerary for circumstances beyond its control, it has the right to change accommodation provider, means of transport, change the schedule or rearrange the itinerary in other ways provided the quality and nature of the tour are not significantly affected thereby. The traveller must be notified of all changes as soon as possible.
4.9 Marmot has the right to make changes in excursion program if the excursion on the specific day is prevented by weather conditions, transportation problems or other circumstances beyond the control of Marmot and also has the right to make changes to any specific excursion program if due to unforeseen circumstances or for reasons beyond its control the excursion is not possible or safe in a planned manner.
4.10 Marmot has the right to cancel the contract if after the conclusion of the contract the possibilities to organize the tour in an agreed manner are considerably more difficult at or near the destination due to occurrences of war, natural disaster, strike or similar situation or if the journey cannot be organized for other unexpected reason without compromising travellers’ health and life. Marmot shall inform the traveller about rescinding the contract as soon as possible. If the contract is cancelled due to force majeure, the traveller has the right to reimbursement of travel expenses, from where reasonable compensation for the services provided or the services to be provided to end the journey, have been deducted. Marmot shall provide the traveller with equivalent transport back to the place of departure. If additional costs incur during the return journey, these costs shall be borne by Marmot and a traveller in equal shares. Other additional expenses arising from cancellation of the contract such as accommodation, meals, etc. shall be borne by the traveller. Marmot shall assist the traveller to find appropriate solutions and organizing the accommodation.
5. Withdrawal from travel contract and cancellation of travel reservation
5.1 Both parties can withdraw from the travel contract if the other party violates the contract.
5.2 A traveller has the right to cancel, without penalty, a travel contract already booked or entered into if he has not paid fully or in part, for the travel package.
5.3 After the traveller has paid the price of the travel package, the refund policy in case the traveller cancels his reservation is as follows:
- 21 days before the departure, no refund is possible
- 22 to 30 days before the departure, the traveller can get refund 50% of the paid amount
- more than 30 days before the departure, the traveller can get refund 75% of the paid amount
- In all above cases, the traveller may find another person to replace him/her instead. This new person must contact Marmot as soon as possible to proceed with the change, but this change is not guaranteed. If the new traveller successfully replaces the first one, they shall arrange the payment of the travel package between them.
5.4 Marmot refund policy applies to the amount that has been paid by the traveller to Marmot. Marmot does not refund amounts paid to third parties (for example the purchase of a visa).
5.5 Marmot has the right to cancel a travel package if the number of travellers is smaller than the number of participants as a precondition of the package. Marmot shall notify the traveller about the withdrawal as soon as possible.
6. Settlement of disputes
6.1 Marmot and the traveller shall settle disputes arising from interpretation of the Terms & Conditions and travel contract through negotiations.
6.2 Marmot and the traveller shall adopt all measures to solve disputes through negotiation. If the parties do not reach an agreement, the disputes shall be settled in the Consumer Protection Office or in the judicial procedure established by the legislation of the Republic of Estonia.
